標題: Google如何回應台北市政府法規會明天分曉
在先前Google與台北市政府法規會談論結果，Google依然堅持本身15分鐘鑑賞期機制，最後則由台北市政府再給予兩週時間進行研擬，而Google目前將在8月3日再與台北市政府法規會進行談判，預計屆時將可確認Android Market之後在台灣地區的後續方向。

針對Android Market付費App的退費模式是否比照台灣消保法規定，在Google尚未再次向台北市政府法規會表明立場前，國內四大出版公協會也呼籲應針對不合時宜且不周全的法令作修改，否則將造成特定消費者在「消費」付費App後申請退費，進而造成業者損失。不過，後續台北市政府則是再引述近期歐盟準備提出的線上交易提供14日鑑賞期條款，準備以此作為其強力後盾。

但從歐盟釋出新聞稿內容來看，其中確實提到「14 Days to change your mind on a purchase (如下)」的部份，說明歐盟將準備施行比先前提供7天還要"寬敞"的鑑賞期，消費者可在此期限內隨時提出退貨退款的申請，但僅限線上、電話或郵件訂購交易之物品，在現場可由消費者本人檢視確認的購物則不在此限。

4) 14 Days to change your mind on a purchase

The period under which consumers can withdraw from a sales contract is extended to 14 calendar days (compared to the seven days legally prescribed by EU law today). This means that consumers can return the goods for whatever reason if they change their minds.

但是，歐盟在以下條款中也特別針對「數位內容 (digital content)」產品退費作相關限制說明 (如下)，其中則是提到消費者可以就音樂或影片等數位下載內容作退費申請，但前提是在整個下載過程開始之前。換句話說，若台北市政府準備引述歐盟新法來要求Google的話，不但無法直接套用在Google現行付費下載機制，恐怕連蘋果等線上付費下載內容也都無法適用。

9) Better consumer protection in relation to digital products

Information on digital content will also have to be clearer, including about its compatibility with hardware and software and the application of any technical protection measures, for example limiting the right for the consumers to make copies of the content.

Consumers will have a right to withdraw from purchases of digital content, such as music or video downloads, but only up until the moment the actual downloading process begins.

不過，這部份還是要看台北市政府如何解讀數位音樂、數位影片或數位App是什麼樣的「商品」，同時也看Google將會做出什麼樣的回應，一切就等明天可知道結果了。

以目前情況來看，Google應該還不至於選擇將Android Market退出台灣市場，但或許會在某些程度上想辦法說服台北市政府法規會，或者是在特定範圍內選擇退讓？
